In Idaho, you only have a certain amount of time to file your personal injury claim with the court until your claim is barred forever so that you may not pursue any compensation whatsoever. This deadline is referred to as the statute of limitations. In Idaho, the general statute of limitations is two (2) years. That means the claim must be filed within two years from the date the accident happened.
That does not mean that you cannot start the claim with the insurance company and negotiating with them to resolve the matter with a settlement agreement. That is the general nature of a personal injury claim; negotiating with at-fault party’s insurance company. The sooner you bring a personal injury lawyer on board, the better.
There are other important considerations when you are thinking about timing of the claim as well. One, if you are bringing an attorney on board, make sure to contact the attorney well in advance of the statute of limitations so that they have an opportunity to review the case, facts, and liability in order for them to be able to present the case to the court with the initial complaint. Other things that you may need to consider is who the defendant is. If the defendant is a governmental entity, you must file a notice of tort claim with the entity within six months from the date of the accident or the claim will be barred.
As you can see, personal injury claims are time sensitive in nature. If you have been injured as a result of someone else’s negligence, contact Nampa Injury Lawyer today to set up your free consultation.
